Regulations Regarding Tree Removal
When planning on removing a tree there are a few rules put in place to protect our Brisbane ecosystem. Not all trees are eligible to be removed, if a tree is considered to be significant or have heritage values then it cannot be removed without council approval. Energetic Trees can help you determine whether your tree is protected or not, in most cases we’re required to contact Brisbane City Council for confirmation.
It is very important to follow these regulations to ensure that Brisbane’s flora and fauna can be enjoyed for years to come. There are significant fines involved when a protected tree has been removed without approval, upwards of $100,000. These fines extend not only to the contractor but also to the customer. Am I Allowed To Cut Down My Neighbour's Tree?
In suburban Brisbane, we regularly encounter trees that are affecting the neighbour’s property. Your neighbour’s tree is considered to be affecting your property if it is likely to injure anyone on your property, cause any damage or unreasonably get in the way of your enjoyment of the land (such as blocking solar panels). Normal tree debris is not considered to be affecting your property.
If a branch overhangs by 50cm or more and/or is less than 2.5 metres above the ground and you wish to have it cut back, you will need to formally notify your neighbour by stating a date (at least 30 days) that you wish to have the branches removed by and provide them with a quote. If the tree branches are not trimmed by the date set, Energetic Trees can cut the branches back for you, your neighbour will be liable to cover up to $300.
If a tree overhangs by up to/more than 0.5m and the branch is 2.5 meters above the ground then you would have to apply to Queensland Civil and Administrative Tribunal seeking a tribunal order before removal of the tree.
